Domestic violence can be broadly defined as an assault and battery by one partner to the other in a relationship such as marriage, dating, family, friends or cohabitation. Domestic violence has many forms including physical aggression (hitting, kicking, biting, shoving, restraining, slapping, throwing objects), or threats thereof; sexual abuse; emotional abuse; or intimidation. After a misdemeanor domestic violence conviction a judge sentences a defendant to a minimum of three years of probation and a 52-week mandatory batterers or domestic violence program that the defendant has to pay for. In domestic violence cases, the DA's office generally seeks to have the court impose a jail sentence in addition to the program.
