Murder is the unlawful killing of a human being with malice aforethought. Malice can be expressed (intent to kill) or implied. Implied malice is proven by acts that involve reckless indifference to human life or in a death that occurs during the commission of certain felonies (the felony murder rule). Under California law, first or second degree murder carries with it a life sentence. Although a person convicted of first or second degree murder is technically eligible for parole after serving a certain minimum number of years, typically 25 or 15, currently very, very few convicts are paroled from a life sentence. Some types of murder carry the death penalty, although sometimes a sentence of life without the possibility of parole is an option in those cases.
